1. Acceptance of Terms
By downloading, accessing, or using the KinderReady Path app (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. If you are using the Service on behalf of a school district or daycare, you represent that you have the authority to bind that organization to these Terms.
2. Description of the Service
KinderReady Path is a kindergarten readiness app designed for parents and guardians to help prepare their children for kindergarten. The Service includes readiness checklists, state-specific curriculum trackers, daily activity suggestions, routine builders, social-emotional learning resources, educational games, printable worksheets, progress dashboards, and kindergarten registration guidance. The Service is not a replacement for professional educational, developmental, or medical advice.
3. Account Registration
To use the Service, you must create an account and provide accurate, complete information. You must be at least 18 years old to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at kinderreadypath@gmail.com.
4. Parental Responsibility
The Service is designed for use by parents and guardians. You are solely responsible for supervising your child's use of the app and for determining which activities are appropriate for your child. You understand that children should not create accounts or enter personal information directly. All child profiles are created and managed by the parent or guardian.
5. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Service; (c) share, sell, or distribute license keys beyond the terms of your purchased license; (d) reproduce, copy, or resell any content from the Service; (e) use the Service to harm, harass, or exploit any child; or (f) interfere with or disrupt the Service's servers or networks.
6. License Keys
District and daycare license keys are intended for distribution to families within the purchasing organization's service area. License keys are capped at a maximum number of family redemptions based on the purchased plan tier. License keys expire one year from the date of purchase and do not auto-renew. Sharing a license key beyond the intended audience or exceeding the redemption cap is a violation of these Terms.
7. Payment Terms
The Service is offered as a one-time purchase for individual families ($4.99), an additional child profile fee ($1 per profile), and annual licenses for daycares and school districts ($250–$2,000 per year). All payments are processed securely through Stripe. By making a purchase, you authorize us to charge the listed price to your payment method. License fees are billed annually and do not auto-renew.
8. Refunds
Our refund policy is described in detail on our Refund Policy page. In summary: individual family purchases include a 14-day satisfaction guarantee; district and daycare licenses may be refunded within 30 days only if the license key has not been distributed to families; additional child profile fees are non-refundable.
9. Intellectual Property
All content included in the Service — including readiness checklists, curriculum guides, activities, worksheets, games, graphics, and text — is the property of KinderReady Path and is protected by United States copyright and intellectual property laws. You may use the Service for personal, non-commercial family use. Schools and districts may distribute license keys to families but may not reproduce, resell, or publicly distribute the Service's content.
10. User Content
Any journal entries, notes, or photos you upload to the Service remain your property. By uploading content, you grant KinderReady Path a limited license to store and display that content within your account. We do not share, sell, or use your uploaded content for any purpose other than providing the Service to you. You may delete your content at any time within the app, and account deletion removes all associated data.
11. Data Privacy
We take your privacy seriously. Our data practices are described in our Privacy Policy. In summary: all data is parent-owned, we do not sell personal data, we do not store student records or personally identifiable information covered under FERPA, and we comply with COPPA and CCPA requirements. 12. No Educational Guarantee
The Service provides educational resources and tools to support kindergarten readiness. We do not guarantee any specific educational outcome, developmental milestone, or admission result. Your child's readiness depends on many factors beyond the Service, and parents are encouraged to consult with educators and developmental professionals as needed.
13. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Your use of the Service is at your own risk.
14. Limitation of Liability
To the maximum extent permitted by law, KinderReady Path and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of or inability to use the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the twelve months preceding the claim.
15. Indemnification
You agree to indemnify and hold harmless KinderReady Path and its creators from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the Service, your violation of these Terms, or your infringement of any third-party rights.
16. Termination
We may suspend or terminate your account at any time if you violate these Terms. You may stop using the Service and delete your account at any time within the app. Upon termination, all licenses and access granted to you cease immediately. District and daycare licenses that are terminated due to Terms violations are not eligible for refunds.
17. Changes to These Terms
We may update these Terms from time to time. We will notify users of material changes through the app or via email. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which the Service operator resides, without regard to conflict of law principles.
